Terms of use

1. Scope

These terms of use apply to the use of Wedding Buddy, a web service by benzl (Luka Benzia). By registering for and using the app, you agree to these terms.

2. Description of the service

Wedding Buddy is a digital wedding planning app. It lets you manage guest lists, seating charts, budgets, playlists, appointments, tasks, a wedding website for your guests and other parts of the planning.

After a free trial a wedding is unlocked once, in one of three sizes. The sizes differ in the storage for photos and files, in the number of people on the planning team and in how long the photo gallery is kept. The sizes and prices in force are shown on the home page and in the app under Settings → Plan & billing. There is no subscription; moving up to a larger size costs the difference.

The gallery's photos are not stored indefinitely. They are kept for 12 months after the wedding day entered, 24 months in the largest size; where no wedding day is entered, for 24 months after the wedding was created. After that they are deleted. Before then we notify every member of the planning team three times by e-mail, the first time at least 30 days before the deletion, and you can download all photos at once. All other data of the wedding (guest list, budget, files etc.) is not affected.

The service is provided "as is". We aim for high availability but cannot guarantee 100% availability.

3. Registration & credentials

Using the app requires registering with an email address or signing in with a Google account. You are responsible for keeping your credentials secret and for all activity that takes place under your account.

Please tell us immediately about any unauthorised use of your account.

4. Ownership of data

Your data belongs to you. All data you enter (guest lists, budgets, playlists, photos etc.) is your property. We claim no rights to your wedding planning data.

You can export your data at any time and delete your account including all of its data.

5. Your obligations

You agree not to misuse the app. In particular, it is prohibited to:

• enter false or misleading data
• use it for commercial purposes without express permission
• attempt to compromise the security of the system
• enter third parties' data without their consent (where relevant under data protection law)
• read out data automatically (scraping)

6. Data protection & guest lists

As a user you are yourself responsible for complying with data protection law when handling your guests' data (e.g. that you are entitled to store your guests' addresses and photos). Our privacy policy sets out how we handle your data.

7. Limitation of liability

benzl is not liable for damage caused by data loss, system outages or errors in the app. Backing up data regularly is the user's responsibility.

Liability for slight negligence, and for lost profits and consequential damage, is excluded to the extent permitted by law.

8. Availability & maintenance

We reserve the right to interrupt the service temporarily for maintenance, or to discontinue it. If the service is discontinued permanently, registered users will be informed 30 days in advance and given the opportunity to export their data.

9. Changes

We may amend these terms of use. Signed-in users are notified of significant changes. Continuing to use the app after a change counts as acceptance.

10. Governing law & jurisdiction

Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, Austria.
